1. Introduction and Acceptance of Terms
Egghey is a brand owned and operated by BIG CAT COMM SDN. BHD. (202101020363 / 1420663-X), a company duly incorporated under the laws of Malaysia (“the Company”, “we”, “our”, or “us”). These Terms & Conditions (“Terms”) govern your access to and use of the Egghey website at www.egghey.com (the “Platform”), including any orders, accounts, and participation in our Yolk Points loyalty programme.
By accessing or using our Platform, placing an order, or creating an account, you confirm that you have read, understood, and agree to be legally bound by these Terms and our Privacy Policy. If you do not agree, please discontinue use immediately.
These Terms are governed by the laws of Malaysia, including the Consumer Protection Act 1999, Electronic Commerce Act 2006, and Personal Data Protection Act 2010.
2. Eligibility
You must be at least 18 years of age, or have obtained verifiable parental or guardian consent, to use this Platform. The Company reserves the right to refuse service, terminate accounts, or cancel orders at our sole discretion.
3. Account Registration
To place orders and earn Yolk Points, you must register an account. You agree to:
- Provide accurate, current, and complete information during registration;
- Keep your login credentials confidential;
- Notify us at hello@egghey.com immediately of any suspected unauthorised access;
- Accept full responsibility for all activities under your account.
We reserve the right to suspend or terminate any account suspected of fraudulent, abusive, or unlawful activity.
4. Orders, Pricing, and Payment
4.1 Placing Orders
When you place an order, you are making an offer to purchase at the listed price. A binding contract is formed only upon the Company’s express confirmation. We reserve the right to refuse, cancel, or limit any order at any time.
4.2 Pricing
All prices are in Malaysian Ringgit (MYR) inclusive of applicable taxes unless stated otherwise. Prices are subject to change without notice.
4.3 Payment
Payment is processed by Billplz (billplz.com), a licensed payment gateway in Malaysia. The Company does not store your full card or bank account details. Your use of Billplz is subject to Billplz’s Terms of Service.
5. Delivery
Delivery is available within service areas specified on the Platform. Estimated delivery times are a guide only and are not guaranteed. The Company shall not be liable for delays caused by circumstances outside our reasonable control. You are responsible for providing an accurate delivery address.
6. Order Cancellation
You may request cancellation only before the order has been confirmed and preparation has begun. Once confirmed, cancellation is no longer available. If the Company cancels your order, any amount charged will be refunded to your original payment method or credited as Yolk Points at our discretion.
7. No Return & Refund Policy
If you receive an incorrect, missing, or unacceptable-quality order due to our error, please contact us at hello@egghey.com within 24 hours with photographic evidence. Subject to verification and at our sole discretion, we may offer compensation in the form of Yolk Points only.
No cash refunds, credit card reversals, or product exchanges will be provided under any circumstances, except as expressly required by applicable Malaysian law. This is consistent with the perishable goods exemption under the Consumer Protection Act 1999.
8. Yolk Points Loyalty Programme
8.1 Earning Yolk Points
Yolk Points are loyalty reward points awarded for qualifying purchases. Earn rates are set at the Company’s sole discretion and may vary by product, promotion, or membership tier.
8.2 Redeeming Yolk Points
Yolk Points may be redeemed against eligible future orders on the Platform. Yolk Points have no monetary or cash value and cannot be transferred, sold, or exchanged for cash.
8.3 Expiry
Yolk Points expire 12 months from the date earned unless otherwise stated. Expired points cannot be reinstated.
8.4 Programme Modification
The Company reserves the right at any time, without prior notice, to change, suspend, or discontinue the programme; modify earn/redemption rates; forfeit points where fraud is detected; or terminate a member’s participation for breach of these Terms.
8.5 Yolk Points as Sole Remedy
Where the Company compensates you for an order issue, compensation shall be in the form of Yolk Points only. This constitutes full and final settlement of any claim arising from that order.
9. Intellectual Property
All content on the Platform is the property of BIG CAT COMM SDN. BHD. or its content suppliers and is protected under Malaysian copyright law. You are granted a limited, non-exclusive, non-transferable licence for personal, non-commercial use only.
10. Prohibited Conduct
- Use the Platform for any unlawful or fraudulent purpose;
- Attempt to gain unauthorised access to any part of the Platform;
- Introduce viruses, malware, or other harmful material;
- Scrape or harvest data without our written consent;
- Submit false, misleading, or defamatory content;
- Abuse the Yolk Points programme through fraudulent transactions.
11. Disclaimer of Warranties and Limitation of Liability
The Platform is provided on an “as is” and “as available” basis without warranties of any kind, to the fullest extent permitted by Malaysian law. Our total aggregate liability for any claim shall not exceed the amount paid by you for the specific order giving rise to the claim.
12. Indemnification
You agree to indemnify and hold harmless BIG CAT COMM SDN. BHD., its officers, directors, and employees from any claims, liabilities, or expenses arising from your use of the Platform or violation of these Terms.
13. Third-Party Links and Services
The Platform may link to third-party services. We are not responsible for their content, privacy practices, or policies. Your use of third-party services is at your own risk.
14. Privacy and Data Protection
Our collection and use of your personal data is governed by our Privacy Policy, which complies with the Personal Data Protection Act 2010 of Malaysia.
15. Amendments to Terms
We reserve the right to modify these Terms at any time. Material changes will be communicated via notice on the Platform or by email. Your continued use after changes constitutes acceptance.
16. Governing Law and Dispute Resolution
These Terms are governed by the laws of Malaysia. Disputes shall first be subject to good-faith negotiation. If unresolved within 30 days, the matter shall be submitted to the exclusive jurisdiction of the courts of Malaysia.
17. Severability and Entire Agreement
If any provision is found invalid or unenforceable, the remaining provisions continue in full force. These Terms together with our Privacy Policy constitute the entire agreement between you and the Company.
